Pirochan Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using the iOS app “Pirochan” (the “App”) provided by Ghost+ (“we,” “us”). By downloading or using the App, you agree to these Terms.

Article 1 (Scope)

These Terms apply to every relationship between us and users regarding the use of the App. They apply in addition to Apple’s Licensed Application End User License Agreement. If the two differ, Apple’s agreement prevails.

Article 2 (License)

Subject to these Terms, we grant you a non-transferable, non-exclusive right to use the App for your personal enjoyment on Apple devices that you own or control.

Article 3 (Intellectual Property)

All rights in the program, images, music, sound effects, characters, story, text, and any other works included in the App belong to us or to their rightful owners. The license under these Terms does not transfer any of these rights to you.

Article 4 (Posting Gameplay Videos and Screenshots)

You may post gameplay videos, live streams, and screenshots of the App on video sites and social media, as long as you clearly credit the App by name (“Pirochan”). Monetization through the platform you post to (such as ad revenue) is also allowed. However, distributing the music or images extracted on their own, and posts intended to harm the reputation of the App or of us, are not permitted. Depending on the circumstances, we may ask you to remove a post.

Article 5 (Prohibited Conduct)

When using the App, you must not:

  1. copy, modify, or extract all or part of the App (including its images, music, sound effects, and text) and distribute, sell, or make it publicly available (except for posts permitted under Article 4);
  2. reverse engineer, decompile, or disassemble the App, or analyze or tamper with its data (except to the extent permitted by law);
  3. interfere with the operation of the App, or manipulate game progress or records (including scores sent to Game Center) by improper means;
  4. infringe the copyrights, trademarks, or other rights or interests of us or any third party;
  5. violate any law or public order and morals; or
  6. engage in any other conduct that we consider inappropriate.

Article 6 (Changes to or Discontinuation of the App)

We may change the content of the App, or stop providing it, without prior notice to users.

Article 7 (Disclaimer)

  1. We do not guarantee that the App is free of bugs or errors, that it is fit for any particular purpose, or that it works on every device.
  2. Except in cases of our intentional misconduct or gross negligence, we are not liable for any damage you suffer from using the App (including loss of saved data).
  3. Notwithstanding the preceding paragraph, where we are liable under Japan’s Consumer Contract Act or other laws, our liability for damage caused by our ordinary negligence is limited to ordinary and direct damage actually incurred by you, up to the amount you paid us for the App.
  4. Nothing in the preceding paragraphs limits any consumer rights you have under the laws of the country or region where you live.

Article 8 (Changes to These Terms)

We may change these Terms as needed. The revised Terms take effect when they are posted on this page. If you use the App after a change, you are deemed to have agreed to the revised Terms.

Article 9 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute concerning the App or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
